In short

Yes, a three-wheel e-trike with pedals and a motor of 750 watts or less is a legal e-bike in California. No license, registration or insurance is needed. Adults need a helmet only on a Class 3 (28 mph) model. You can ride on roads and in bike lanes, but cities, counties and State Parks may close particular paths or trails to e-bikes, so check posted signs.

No insurance is required (the rider is exempt from the financial-responsibility law).
Helmet
Riders and passengers under 18 must wear a bicycle helmet on any bike, including an e-bike.
Minimum age
Riders must be 16 or older to operate a Class 3. State law sets no minimum age for Class 1 or 2, but pilot laws let San Diego County and Marin County set local limits, listed under local rules below. (Class 3)

E-bike riders have the same road rights and duties as bicyclists, including use of bike lanes.

Moped definition: 'a two-wheeled or three-wheeled device having fully operative pedals ... and a motor that produces less than 4 gross brake horsepower and is capable of propelling the device at a maximum speed of not more than 30 miles per hour.' DMV says no insurance is needed to register a moped, and mopeds have no annual renewal. Anything faster or more powerful is a motor-driven cycle or motorcycle, which needs full registration, insurance and an M1 license. § 312.5(d) says a modified or 'modifiable' e-bike is not an e-bike.

What we couldn't confirm from official sources (4)
  • SB 1167, AB 2346 and AB 2595 had no Governor action as of 2026-09-28 (leginfo still shows them 'Enrolled and presented'; the Governor's 9/20 and 9/27 updates did not list them). The deadline is 2026-09-30, so recheck before publishing. A bill with no action by then becomes law.
  • AB 1909 (2022) removed the former statewide ban on Class 3 e-bikes on Class I bike paths, and local agencies may now regulate them. The current § 21207.5 text has no Class 3 ban, but I did not pull AB 1909 itself.
  • Sidewalk riding is not regulated for e-bikes at the state level and is left to local ordinance (Veh. Code § 21206). Not verified by fetching § 21206.
  • The Marin pilot's helmet-for-all-Class-2-riders element and its July 1, 2025 start come from Marin County and secondary pages. The § 21214.5 text I saw quoted only the under-16 Class 2 authority.
